          The Board of Directors of the San Benito County Water District convened in Special Session.  Directors James DeLaCruz, Robert Swanson, Ken Perry, Douglas Keck and John Tobias were present together with District Manager/Engineer John S. Gregg, District Counsel David Pipal and Administrative Services Officer Janet L. Miller.

 

1.                 Proof of Publication submitted on Notice of Public Hearing

 

Administrative Services Officer Janet L. Miller reported that the Notice of Public Hearing was published on December 21, 2000 in the Pinnacles and on December 22, 2000 in the FreeLance Newspapers.

 

2.                Public Hearing regarding 1999-00 Groundwater Report

 

a.       Presentation of Report (Jones and Stokes)

 

District Manager/Engineer John S. Gregg introduced Tom Engels and Kyle Kier from Jones and Stokes.  Mr. Kier gave a brief presentation and turned it over to Gus Yates, who presented the 1999-00 Groundwater Report.  Mr. Yates reviewed the annual groundwater levels throughout the county and the suggested recommendations.

 

b.                 Questions by Directors

 

President Swanson asked if the Directors had any questions.  Director Tobias asked if the figure of 13,000 ac ft imported water referred to both M&I and Agricultural water.  Mr. Yates stated it did.

Director Keck asked if the seismic situation in the county should be looked at in regards to the groundwater levels.  Mr. Yates stated a professional could be hired to research that.

Director Swanson asked where the groundwater was tested around the sewer ponds.  Mr. Yates stated it was tested post treatment, pre percolation. 

Director Perry stated in the San Juan Valley if the farmers irrigated with well water, it will percolate and if the farmers irrigated with San Felipe water, it will run off and not percolate.

President Swanson opened the Public Hearing.  No one from the public came forward to speak during the Public Hearing portion of the meeting.

President Swanson closed the Public Hearing.

 

3.                Acceptance of 1999-00 Groundwater Report

4.                Consider Adoption of Statement of Findings and Recommendations

 

District Manager Gregg stated for the record that Table 9 of the 1999-00 Groundwater Report showed a reduction in the groundwater subbasin levels in the San Juan, Hollister West and Pacheco areas of Zone 6. 

 

Upon motion duly made, seconded and unanimously carried, the 1999-00 Groundwater Report was adopted, including the discussion of the Directors and including Findings as follows:

 

          The Motion accepts the Annual Groundwater Report for the 1999-2000 Water Year prepared by Jones & Stokes for the San Benito County Water District shall include findings made by the Board in support of such acceptance as set forth in Water Code Appendix §70-7.6.  The findings are as follows:

 

1.                 The report contains information considered by the Board in determining annual overdraft and accumulated overdraft as of September 30, 2000.

 

2.                 The report contains information as to the total production of water from the groundwater supplies of the District and the zones thereof for the Water Year ending September 30, 2000.

 

3.                 The report contains an estimate of the annual overdraft for the 1999-2000 Water Year and for the ensuing water year.

 

4.                 The report contains information to determine the estimated amount of agricultural water and water other than agricultural water to be withdrawn from the groundwater supplies of the District and the zones thereof for the 2000-2001 Water Year.

 

5.                 The report contains information as to the amount of water the District is obligated to purchase during the 2000-2001 Water Year.

 

6.                 The report recommends the quantity of water needed for surface delivery and for replenishment of groundwater supplies of the District and the zones thereof for the 2000-2001 Water Year.

 

The report recommends that a groundwater charge should be levied in the zones of the District for 2001-2002 and proposes a rate per acre foot for agricultural water and a rate per acre foot for water other than agricultural water.

President Swanson adjourned the meeting.
