          The Board of Directors of the San Benito County Water District convened in Special Session. Directors Wm. Rupert, Ken Perry, Gary Gonzales and John Tobias were present together with District Manager/Engineer John S. Gregg, District Counsel David Pipal and Administrative Services Officer Janet L. Torres.

1.       Proof of Publication submitted on Notice of Public Hearing

          President Tobias requested proof of publication of the Notice of Public Hearing. Administrative Services Officer Janet L. Torres stated the Notice was published in the FreeLance on December 29 and 30, 1999 and the Resolution No. 99-17 setting a public hearing date was published in the FreeLance on December 29, 1999.

Director Rupert requested an item be placed on this Agenda regarding the extension of the outage to Subsystems 1 through 6. He stated he felt this was an urgent matter and wanted an explanation. District Manager/Engineer John S. Gregg stated that due to unforeseen complications, the contractors were behind schedule and needed to extend the outage. He stated the pipe would be capped off, re-watered and the water would be back on sometime next week. He then stated that sometime in February, when the remaining work was complete, the system would need to be de-watered, the cap taken off and the pipe reconnected. He stated that outage would be for approximately one week at that time.

2.      Public Hearing/Meeting Regarding 2000-2001 Rates and Charges:

    1. Presentation of 2000-2001 Rates and Charges
    2. Resolution Establishing Standby or Availability Charge for the 2000-2001 Water Year
    3. Ordinance Establishing San Felipe Distribution System Water Charges for Agricultural and Non-Agricultural Water
    4. Resolution Establishing Groundwater Charges in Zone 6 for the 2000-2001 Water Year

District Manager/Engineer John S. Gregg presented the proposed 2000-2001 Rates and Charges. He stated the charges were based primarily upon the costs for imported water, including operation and maintenance of Central Valley Project facilities by the San Luis-Delta Mendota Water Authority. He also stated the costs for imported water are Draft 2000 USBR Rates and estimated San Luis-Delta Mendota Water Authority Rates.

President Tobias opened the Public Hearing portion of the meeting, and hearing no public comment, the Public Hearing portion was closed.

3.      Consider Adoption of Resolution Implementing a Standby or Availability Charge for the 2000-2001 Water Year

          Upon motion duly made, seconded and unanimously passed, Resolution No. 2000-01 was adopted.

4.      Consider Adoption of Ordinance Establishing San Felipe Distribution System Water Charges for Agricultural and Non-Agricultural Water

          Upon motion duly made, seconded and unanimously passed, Ordinance No. 30 was adopted.

5.      Consider Adoption of Resolution Establishing Groundwater Charges in Zone 6 for the 2000/2001 Water Year

Upon motion duly made, seconded and unanimously passed, Resolution 2000-02 was adopted.

6.      Consider Revisions and Modifications to the Rules and Regulations for Delivering and Receiving San Felipe Water

          District Manager/Engineer John S. Gregg presented the proposed changes to the current Water Contracting Procedure.
