The Board of Directors of the San Benito County Water District convened in Special Session. President Kenneth Perry, Directors Bill Rupert, Gary Gonzales and John H. Tobias were present together with District Manager/Engineer John S. Gregg, District Counsel Dave Pipal, Operations and Maintenance Supervisor Cliff Thatcher, and Administrative Services Officer Janet L. Torres.
President Perry called the meeting to order and requested all to stand and recite the Pledge of Allegiance
District Manager/Engineer Gregg presented the recommended rates and charges for the 1999-2000 Water Year. He stated the District was given authority for charging rates by a ballot measure approved by the voters.
Manager Gregg stated the committee’s recommendation is to continue the current $6.00 charge for standby and availability (blue valves). He stated according to Proposition 218 the board’s authority to increase the charge would require that the lands that benefit, vote for the increase. President Perry asked if the benefited property owners voted or all of Zone 6? Manager Gregg stated just the properties that pay the assessment would be able to vote.
President Perry asked if there were any questions before the public hearing is open? Hearing none the public hearing was opened.
a. Resolution Establishing Standby or Availability Charge for the 1999-2000 Water Year
President Perry requested proof of publication. Administrative Services Officer Torres stated the Public Notice setting a Public Hearing date for the purpose of implementing a standby or availability charge for the 1999-2000 water year was published in the FreeLance on December 31, 1998.
Director Gonzales stated the charges were fair. District Counsel Pipal stated there was a $5.00 increase to full cost rate, which went from $240.00 to $245.00. Director Rupert asked if the District had any customers paying the full cost? District Manager Gregg stated it does.
b. Ordinance Establishing San Felipe Distribution System Water Charges for Agricultural and Non-Agricultural Water
President Perry requested proof of publication. Administrative Services Officer Torres stated the Public Notice for the Public Hearing on the Ordinance was published in the FreeLance on December 31, 1998.
c. Resolution Establishing Groundwater Charges in Zone 6 for the 1999-2000 Water Year
President Perry requested proof of publication for the Public Hearing regarding the proposed resolution establishing groundwater charges. Administrative Services Officer Torres stated the Public Notice was published on January 4th and 7th in the Freelance.
President Perry asked if the Directors had any comments? Director Tobias stated he had no comment. Director Rupert stated he had no comment.
President Perry opened the Public Hearing and asked if there were any comments from the public.
President Perry closed the Public Hearing with no comment from the public.
3. Consider Adoption of Resolution Implementing a Standby or Availability Charge for the 1999-2000 Water Year.
Upon motion duly made, seconded and carried Resolution No. 99-1 was adopted.
Upon motion duly made, seconded and carried Ordinance No. 28 was adopted.
5. Consider Adoption of Resolution Establishing Groundwater Charges in Zone 6 for the 1999/2000 Water Year.
Upon motion duly made, seconded and carried Resolution No. 99-2 was adopted.
President Perry commended staff and the committee.
