          The Board of Directors of the San Benito County Water District convened in Special Session. Directors Bob Swanson, Ken Perry, John Tobias, James DeLaCruz and Douglas Keck were present together with District Manager/Engineer John S. Gregg, District Counsel David Pipal, Deputy District Engineer Jeff Cattaneo and Administrative Services Officer Janet L. Miller.

a.       Pledge of Allegiance to the Flag

          President Keck called the meeting to order and led the Pledge of Allegiance to the Flag.

1.       Proof of Publication submitted on Notice of Public Hearing

          Administrative Services Officer Miller stated the Resolution setting a Public Hearing Date for the Purpose of Implementing a Standby or Availability Charge for the 2003-2004 Water Year and the Notice of Public Hearing to consider an Ordinance setting 2003-2004 San Felipe Project Rates and Charges and a Resolution establishing Groundwater Charges in Zone 6 for the 2003-2004 Water Year were published in the FreeLance on December 26th and 30th, 2002.

2.      Public Hearing/Meeting Regarding 2003-2004 Water Year Rates and Charges

          a.       Presentation of 2003-2004 Rates and Charges

          District Manager Gregg presented the proposed rates and charges for the 2003-2004 Water Year. He stated the rates and charges basically remain unchanged. He stated they do reflect a bi-monthly minimum charge of $25.00 for small parcel service customers. He stated the small parcel service customers have the option to either remain on annual contracting or change to bi-monthly billing. He stated if approved the Rules and Regulations would need to be revised to address the small parcel service.

b.       Resolution Establishing Standby or Availability Charge for the 2003-2004 Water Year

c.       Ordinance Establishing San Felipe Distribution System Water Charges for Agricultural and Non-Agricultural Water

d.       Resolution Establishing Groundwater Charges in Zone 6 for the 2003-2004 Water Year

          District Manager Gregg introduced the Resolutions and Ordinance. He stated the Ordinance needed to be revised to address the small parcel service.

e.       Open Public Hearing

          President Perry opened the Public Hearing. Matthew Mederios asked how much would the customer be charged if they went over their initial allotment of 1 to 2 acre feet? District Manager Gregg stated they would be charged the set rate for M&I or Agricultural water. Mr. Mederios stated he has livestock around the meter and suggested to simplify the reading of the meters a customer could read the meter and notify the District of the reading and the District could periodically check the meter.

          f.       Close Public Hearing or continue to a later date

                   President Perry closed the Public Hearing, hearing no further comment from the audience.

                   Upon a motion duly made, seconded and unanimously carried Resolution No. 2003-01, a Resolution Establishing Standby or Availability Charge for the 2003-2004 Water Year was adopted and Resolution No. 2003-02, a Resolution Establishing Groundwater Charges in Zone 6 for the 2003-2004 Water Year was adopted.

                   Upon a motion duly made, seconded and unanimously carried the Public Hearing was continued to January 29, 2003 for approval of the Ordinance Establishing San Felipe Distribution System Water Charges for Agricultural and Non-Agricultural Water.

          The Board adjourned to a Regular Meeting to be held on January 29, 2003 at 7:30 p.m., 30 Mansfield Road, Hollister, California.
