            The Board of Directors of the San Benito County Water District convened in Special Session.  Directors Ken Perry, Bob Swanson, John Tobias, James DeLaCruz and Douglas Keck were present together with District Manager/Engineer John S. Gregg, Deputy District Engineer Jeff Cattaneo, District Counsel David Pipal and Administrative Services Officer Janet L. Miller.

 

a.         Pledge of Allegiance to the Flag

            President Perry called the meeting to order and led the Pledge of Allegiance to the Flag.

 

1.         Public Hearing/Meeting Regarding Zone 103 (Harmony Hills Water System) 2003 -2004 Water Year Rates and Charges:

 

a.         Presentation of Ordinance Establishing Zone 103 (Harmony Hills Water System) Rates and Charges – District Manager/Engineer Gregg presented the Draft Ordinance including the rates of $55 per month for Service and Demand and $34 per month for an Energy Charge, which represent Option C of the proposed rates and charges schedule presented to the landowners.  District Manager/Engineer Gregg provided a Petition signed by 13 landowners in favor of Option C.  He stated these rates and charges were based upon the current active services.  He also stated the Ordinance includes language that if adopted, the Ordinance would not be effective until all conditions were met. 

b.         Presentation of Resolution Establishing Rules and Regulations for Domestic (Potable) Water Services Charges in Zone 6 for 2003-2004 Water Year - District Manager/Engineer Gregg stated the Rules and Regulations would be revisited to address the meters after construction of the system.

c.         Open Public Hearing – Scott Greth stated District Manager/Engineer Gregg answered the landowners questions and they were working on the key issues.  He stated the landowner parcel map looked complete. 

d.         Close Public Hearing or continue to a later date – President Perry closed the Public Hearing.  Director De La Cruz asked how long the proposed rates would be in effect?  District Manager/Engineer Gregg stated until the beginning of the year when the District reviews all rates and charges.  Director Tobias asked if the use was over the allocation would the rates increase?  District Manager/Engineer Gregg stated the current meters were not accurate and after construction that issue would be revisited.  Kurt Pearce asked if there would be a cap on the rates?  District Manager/Engineer Gregg stated the Parcel fee cannot be increased without an election and the District will be sensitive to the customers regarding the Service Charge.

 

e.         Consideration of:

1)         Ordinance Establishing Harmony Hills Water System Rates and Charges

2)         Resolution Establishing Rules and Regulations for Domestic (Potable) Water Services Charges in Zone 6 for 2003-2004 Water Year

                        Upon a motion duly made, seconded and unanimously passed Ordinance No. 35 was adopted with a statement that it is exempt to CEQA because the rates and charges are for an existing system.

            Upon a motion duly made, seconded and unanimously passed Resolution No. 2003-08 was adopted.
