RESOLUTION NO. 2001 - 09

 

A RESOLUTION SUPPORTING THE PROVISION

EMERGENCY WATER TO STONEGATE SUBDIVISION

 

          WHEREAS, property owners in the Stonegate Subdivision have informed the District that the subdivision lacks an emergency water supply; and

 

          WHEREAS, water including water essentially for health and safety is currently provided to the subdivision through the services of a county service area; and

 

          WHEREAS, the property owners have or will be requesting that the county service area establish an emergency water supply for the subdivision; and

 

          WHEREAS, the property owners have requested that the San Benito County Water District (District) support a proposal that would authorize the pumping of water from a well to be located in Zone 3 and transporting same to the Stonegate Subdivision located in Zone 6 for emergency purposes only; and

 

          WHEREAS, if such support is provided by District, the property owners will thereafter request that the County Board of Supervisors, on behalf of CSA No. 31, authorize the emergency water project; and

 

          WHEREAS, such emergency water project will require approval of the State of California Department of Health Services.

 

          NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:

 

          1.       The Board of Directors of the District hereby supports a proposal which would allow water to be pumped from a well (generally planned to be located in Zone 3 and west of the Stonegate subdivision in the recent alluvium of the Tres Pinos Creek) to the Stonegate Subdivision located in Zone 6 for emergency purposes only; provided, however, that CSA No. 31 shall obtain District’s approval of its plans for construction, operation and maintenance of said project; and, provided further, that said project shall be at no expense to District.

 

          2.       The Board of Directors hereby directs District staff to support the provision of emergency water for CSA No. 31.

 

          3.       “Emergency,” for purposes of this resolution, shall mean a sudden occurrence, such as a storm, flood, fire, or an unexpected equipment or facility outage or failure impairing the ability of the county service area to provide necessary water service and deliveries.

 

          The foregoing Resolution was passed and adopted at a regular meeting of the Board of Directors of the San Benito County Water District held on the 28th day of March, 2001, by the following vote:
