RESOLUTION NO. 2002 - 07
A RESOLUTION OF THE BOARD OF DIRECTORS OF
THE SAN BENITO COUNTY WATER DISTRICT
AMENDING RESOLUTION NO. 97-6 ESTABLISHING
AUTHORITY AND PROCEDURES FOR
INSPECTION AND PRODUCTION OF DISTRICT RECORDS
BE IT RESOLVED by the Board of Directors of the San Benito County Water District that:
Resolution No. 97-6, Section 6 is amended to read:
“6. Miscellaneous Procedures:
Members
of the public may request public information in person, by telephone, e-mail,
fax, or by mail. An information request
form shall be filled out for each request.
A District employee may fill out the form if the request is not made in
person
Within ten (10) days from receipt of the request, the requester will be notified as to whether and when the requested material will be made available. The time for notification may be extended for an additional 14 days because of unusual circumstances as that term is defined in California Government Code Section 6253(c). Copies will be made available at the earliest possible time consistent with the District’s work load. Members of the public shall not be allowed direct access to District files.”
Further Resolution No. 97-6 is amended to add Section 7 to read:
“7. A
request for records by a member of the public must reasonably describe an
identifiable record. To the extent
reasonable under the circumstances, the District will assist the public in
making an effective request for records by:
A. Assisting the public in identifying
records and information that are responsive to the request, which may involve
eliciting additional clarifying information from the public.
B. Describing the physical location of the records and the technology available to recover same.
C. If access to the records is denied by the District, providing suggestions as to how the public may overcome the practical basis for denying access.
Section 7.A. shall be
deemed satisfied if the District is unable to identify the requested
information after having made a reasonable effort to do so.
The requirement of this Section 7 shall not apply to the District if:
A. the District makes the records available
pursuant to the procedures set forth in this Resolution; or
B. the District denies the request for
records based solely on an exemption set forth in Section 4 of this Resolution
or listed in Section 6254 of the Government Code; or
C. the District makes an index of its records
available to the public.”
Except as specifically amended as set forth herein, Resolution No. 97-6 shall remain in full force and effect.
