RESOLUTION NO. 2003 - 12

A RESOLUTION OF THE BOARD OF DIRECTORS OF

THE SAN BENITO COUNTY WATER DISTRICT

AUTHORIZING DISTRICT OFFICERS TO EXECUTE A

MEMORANDUM OF AGREEMENT FOR HYDROGEOLOGIC ANALYSIS

IN THE VICINITY OF THE HOLLISTER DOMESTIC

AND INDUSTRIAL WASTEWATER TREATMENT PLANTS

WHEREAS, San Benito County and the San Benito County Water District have determined that a clearer and more detailed technical understanding of the hydrogeology in the vicinity of the Hollister Domestic and Industrial Wastewater Treatment Plants is required to support public decision making with respect to water resource management and wastewater treatment and disposal in the vicinity of the Hollister Domestic and Industrial Wastewater Treatment Plants; and

WHEREAS, Administrative Civil Liabilities Order R3-2002-0097 - City of Hollister, San Benito County adopted by the California Regional Water Quality Control Board Central Coast Region on November 1, 2002 provides that the City of Hollister "Expend a minimum, $300,000 (or $300,000 plus cost savings from construction of the emergency storage basin) to fund a hydrogeologic study in the vicinity of the Domestic and Industrial Wastewater Treatment Facilities. The study scope, subject to Executive Officer approval, shall include, but no be limited to, the following objectives:

i. "Determine the hydrogeologic conditions in the study area, including principal geologic features, aquifer characteristics, and factors influencing ground and surface water movements.

ii. Determine the mechanisms for and factors influencing constituent transport in ground and surface water in the study area.

iii. Determine if disposal of treated effluent at both the Domestic and Industrial Wastewater Treatment Facilities impacts ground and surface water beneficial uses, and if so, what level of significance is associated with those impacts.

iv. Determine mitigation measures to address any adverse impacts resulting from disposal of treated effluent at both the Domestic and Industrial Wastewater Treatment Facilities.

v. Determine if the existing collective ground and surface water monitoring network is adequate for detecting and evaluating impacts from wastewater disposal activities.

vi. The study shall be designed such that it will be completed by May 20, 2004, for submittal as part of the Report of Waste Discharge for the Discharger’s Long-term Wastewater Management Program required under Provision 7 of Waste Discharge Requirements Order No. 00-020 for the Industrial Wastewater Treatment Facility"; and

WHEREAS, the City of Hollister, San Benito County and the San Benito County Water District have cooperated in the development of a study scope which has been approved by the Regional Board Executive Officer.

NOW, THEREFORE BE IT RESOLVED that the officers of the San Benito County Water District are authorized to execute a Memorandum of Understanding substantially in the form of the attached Memorandum of Agreement for hydrologic analysis in the vicinity of the Hollister Domestic and Industrial Treatment Plants as approved by District General Counsel.
