RESOLUTION NO. 2003 - 13

RESOLUTION OF THE BOARD OF DIRECTORS

OF THE SAN BENITO COUNTY WATER DISTRICT

SETTING FORTH ITS INTENTIONS REGARDING

PERCOLATION OF SAN FELIPE PROJECT WATER

FOR WATER CONTRACT YEAR 2003-2004

WHEREAS The Board of Directors of the San Benito County Water District hereby resolves as follows:

That Item 2 of Resolution 94-07 is suspended through February 29, 2004;

That percolation of San Felipe Water directly or through coordination with Zone 3 shall be limited to 500 acre feet of Irrigation water and 1000 acre feet of M&I water (the amounts assumed in the development of the 2003-2004 Groundwater Rates).

That San Felipe water shall only be used for in-stream or other artificial percolation in the following sub-basins or portions of sub-basins:

Tres Pinos, Hollister West south of the Cienega Bridge and Hollister East within the watershed of Santa Ana Creek and south of McCloskey Road.

That percolation of San Felipe Project Water (Zone 6) be coordinated with the percolation operations of the San Benito River System (Zone 3) to the mutual benefit of those zones.

That this Resolution shall be effective through February 29, 2004 at which time its provisions shall terminate.

THE FOREGOING RESOLUTION was adopted at a Regular Board Meeting held on the 26^th day of March, 2003 by the following vote:
