WHEREAS, the Board of Directors of the San Benito County Water District ("District") previously adopted Resolution No. 96-5 (Exhibit A) establishing a policy for inter-subsystem water transfers, which was designed to mitigate potential impacts on well users in the groundwater basin from which water is being transferred

WHEREAS, the damaged Hollister Conduit has limited the water supply and thereby caused an emergency situation; and

WHEREAS, a number of District customers request transfers of project water between District subsystems without limitations found in Resolution 96-5.

WHEREAS, the facts and findings that supported the mitigation of potential impact on well users in the groundwater basin from which water is being transferred do not apply under the emergency situation caused by the damaged Hollister Conduit.

NOW, THEREFORE, the Board of Directors of the San Benito County Water District hereby resolves as follows:

1. Effective immediately the Board of Directors hereby authorizes the temporary suspension of the limitations listed in Resolution 96-5 (1 b,c,d,e,f, & g).

1. The Board of Directors shall later determine when the temporary suspension of limitations on inter-subsystem water transfers found in Resolution 96-5 (1 b,c,d,e,f & g) will no longer apply.

1. The suspension shall continue for the 1998-99 water year and automatically terminate on February 28, 1999 unless prior thereto the Board extends the effective date of the suspension. If the suspension expires, the conditions set forth in Resolution 96-5 shall be reinstated.

THE FOREGOING RESOLUTION was adopted at a regular meeting of the Board of Directors of the San Benito County Water District held on March 25, 1998 by the following vote:
